We operate a premier hybrid service platform that connects customers with pre-vetted, highly qualified service professionals while providing unique value-added benefits that set us apart from competitors. We pride ourselves on being your reliable, go-to solution for all service needs, employing skilled artisans, handymen, installers, and technicians dedicated to providing friendly, high-quality service with 100% customer satisfaction guarantee.

By accessing or using our services at www.servicelinksa.co.za, you agree to be bound by these Terms and Conditions and our Privacy Policy.

Platform Role Disclaimer: ServiceLink SA operates as a matching and quality assurance platform. We facilitate connections between customers and independent contractors but are not a party to service agreements. We provide quality oversight but ultimate responsibility for workmanship rests with the individual contractor. Learn more about our approach in our Services Overview.

Eligibility Requirements: You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our services. By using our platform, you represent and warrant that you meet these eligibility requirements.

Modifications: We reserve the right to modify these Terms at any time. Registered subscribers will receive 30 days’ written notice of material changes via email. Continued use of our services after changes constitutes acceptance of the modified Terms.

2. Account Registration and Security

Usage Options:

  • Guest Access: Use our basic services without creating an account, though with limited functionality
  • Registered Membership: Enjoy full benefits by creating a secure account

Benefits of Registration:

  • Free Expert Quotations: Receive free, no obligation, complimentary estimates from our panel of qualified quantity surveyors and industry experts
  • Priority Matching: Get connected with our highest-rated vetted contractors first
  • Exclusive Promotions: Access special discounts and offers available only to registered members
  • Community Participation: Join our “Give-Back” initiative supporting needy communities by simply choosing ServiceLink SA
  • Enhanced Support: Benefit from faster dispute resolution and inspection scheduling
  • Loyalty Rewards: Earn points for every completed service that can be redeemed for future discounts
  • Referral Bonuses: Receive credits for referring new customers to our platform
  • Early Access: Be among the first to book newly onboarded premium contractors
  • Amendment Notice: Receive 30 days’ written notice prior to any amendments to these Terms
  • Free Inspections: Eligible for complimentary pre-work inspections on qualifying projects

Account Responsibilities: You must provide accurate and complete information during registration and maintain the security of your password. You are responsible for all activities under your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activities.

3. Service Request Process

Submit service requests through our categorized forms, providing all necessary details for accurate matching. By submitting a request, you authorize us to share your information with our vetted contractor network for quotation purposes.

Response Times: Most requests receive initial responses within 2 hours during business days (Monday-Friday, 8AM-6PM). For all jobs/services marked as emergency through our emergency option in the request quote form, expect a response time of 3-20 minutes.

Matching Process: We match your request based on service category, location, contractor availability, and performance ratings. We aim to provide 3-5 qualified matches. See our complete How It Works process for details.

4. Pricing, Quotes, and Payment Terms

All quotes provided through our platform are valid for 30 days unless otherwise specified. Pricing may vary based on service complexity, materials required, contractor and contractor availability.

Beat Your Quote Guarantee:
We’re confident in our competitive pricing. If you receive a written quote from a licensed competitor for identical services, we’ll beat it by 7.5-10% guaranteed, subject to:
– Valid documentation proof from the person/contractor who issued the quote
– Identical scope of work and specifications
– Claim submission within 7 days of quote receipt

Payment Options:
– Standard Payments: We accept all major credit cards, EFT transfers, e-wallets and cash payments
– Pay-Later Option: Qualified customers may defer payment subject to:
– Eligibility: Proof of perpetual employment and authorization for salary garnishment
– Repayment Terms: 60-180 days with monthly payments directly redirected from employer to ServiceLink SA
– Default Consequences: Legal proceedings, including collection procedures and potential lawsuits to recover outstanding amounts
– Complete Pay-Later terms

Payment Protection: For services performed by ServiceLink SA-employed artisans, we offer payment protection. For independent contractors, payment terms are negotiated directly with the contractor.

Important Note: Pay Later option applies only to services carried out by ServiceLink SA employed artisans and not by independent contractors hired through our platform.

5. Service Quality Assurance

All contractors on our platform meet stringent quality standards verified through our vetting process. We provide multiple inspection points to ensure quality:

  • Pre-Work Inspection: Verification of scope and requirements (available as free inspection for qualifying projects)
  • During-Work Inspection: Quality and compliance checks
  • Post-Work Inspection: Final approval and satisfaction verification
  • Detailed Reports: Comprehensive inspection documentation available to customers
  • Remediation Process: Structured approach to address any identified issues

Contractor Insurance: Contractors on our platform may carry various insurance coverages. We recommend verifying contractor liability insurance directly with your chosen professional before work begins. ServiceLink SA does not guarantee contractor insurance coverage unless specifically stated in writing.

6. Cancellations and Refunds

Customer Cancellations:
– 48+ hours notice: Full refund of any deposits paid
– 24-48 hours notice: 12% refund of deposits retained to cover administration and financial costs
– <24 hours notice: No refund (emergency exceptions may apply)

Contractor Cancellations:
In the rare event your assigned contractor cannot complete the work:
– Automatic reassignment to equally qualified alternative
– Priority scheduling for inconvenienced customers
– Compensation considerations for significant delays

Emergency Service Cancellations: Must be made before the contractor/technician is dispatched. Once en route, customers are liable for the full call-out fee. Detailed protocols outlined in our Emergency Service Terms.

7. Limitations of Liability and Commercial Risk

Platform Role Clarification: ServiceLink SA serves as a connector between customers and service providers and provides quality assurance oversight. To the fullest extent permitted by South African law, we are not liable for:

  • Contractor performance issues after connection
  • Delays beyond our reasonable control
  • Damages resulting from improper customer instructions or site conditions
  • Force majeure events including natural disasters, strikes, or government actions
  • Financial transactions between you and contractors
  • Contractor compliance with laws, regulations, or insurance requirements

Important Liability Distinction: ServiceLink SA assumes full liability only for jobs performed by our fully employed artisans. For services provided by independent contractors, our liability is limited to cases where the contractor displays all our verification badges and we have conducted paid quality inspections. We do not guarantee performance by independent contractors unless customers specifically opt for detailed inspections by ServiceLink SA.

Commercial Risk Acknowledgement: By using our platform, you acknowledge that engaging service professionals involves inherent commercial risk. ServiceLink SA is not responsible for contractor business decisions, workmanship quality (unless inspections are purchased), or project outcomes beyond our matching and verification services.

Your Due Diligence Responsibilities:

  • Verify contractor credentials, insurance, and references directly
  • Obtain written contracts with clear terms before work begins
  • Ensure necessary permits are obtained for your project
  • Verify work meets regulatory and safety standards
  • Check contractor liability insurance coverage

Liability Cap: To the extent permitted by law, ServiceLink SA’s total liability for any claim related to our platform services is limited to R1000 or the amount paid for the specific service, whichever is lower.

8. Intellectual Property

ServiceLink SA retains all rights to platform content, design, and functionality. Customers grant us a perpetual, royalty-free license to use reviews and content submitted for promotional and improvement purposes while respecting privacy considerations outlined in our Privacy Policy.

9. Privacy and Data Protection

We comply with the Protection of Personal Information Act (POPIA) and other applicable data protection regulations. Customer data is shared only with vetted contractors necessary for service fulfillment. Users may access, correct, or delete their personal data upon request by contacting our Information Officer.

10. Dispute Resolution

We are committed to resolving disputes fairly and efficiently. Our process includes:

  1. Direct Resolution: Attempt to resolve issues directly with your contractor
  2. ServiceLink Mediation: If unresolved within 7 days, our mediation team will facilitate a solution
  3. Formal Arbitration: If mediation fails, disputes will be referred to arbitration in accordance with South African law
  4. Governing Law: All agreements are governed by the laws of South Africa

11. Platform Usage Rules

To maintain a safe and professional environment, we prohibit:

  • Spam, abuse, or harassment of contractors or other users
  • Fraudulent activities or misrepresentation
  • Fake reviews or rating manipulation
  • Attempts to circumvent our platform to avoid fees
  • Any illegal activities under South African law
  • Commercial use of our platform for lead generation

We moderate all communications and reserve the right to remove inappropriate content or suspend accounts that violate these rules. ServiceLink SA reserves the right to remove any reviews from the platform if they are deemed misleading, exaggerated, incorrect, or targeted at unfairly compromising the integrity of our platform. No correspondence or external arbitration will be entered into regarding such removal decisions.

12. Termination

We may terminate or suspend accounts for:

  • Violations of these Terms and Conditions
  • Fraudulent activity or misrepresentation
  • Payment defaults or fraudulent payments
  • Illegal behavior or violations of applicable laws
  • Activities that threaten the security or integrity of our platform

Certain provisions, including those related to intellectual property, limitations of liability, and dispute resolution, survive termination of your account.

Shared Terms and Conditions

Governing Law & Jurisdiction

These Terms and Conditions are governed by the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts. We comply with the Electronic Communications and Transactions Act (ECT Act) and Protection of Personal Information Act (POPIA).

General Disclaimers & Warranties

Services are provided “as is” without warranties of merchantability or fitness for particular purposes. We disclaim liability for errors, omissions, or interruptions in service availability.

Indemnity & Limitation of Liability

Users agree to indemnify ServiceLink SA against claims arising from their use of our services. Our liability is limited to direct damages up to the amount paid for the specific service in question, with caps as specified in Section 7.

Privacy & Data Processing

We collect, process, and store personal information in accordance with our Privacy Policy and POPIA requirements. By using our services, you consent to such processing.

Electronic Communications

You consent to receive electronic communications from us, including emails, SMS messages, WhatsApp messages, and platform notifications, for operational and marketing purposes. WhatsApp messages to your registered number constitute official communication.

Right to Modify or Terminate Service

We reserve the right to modify, suspend, or terminate any aspect of our services at any time, with notice where practicable.

Force Majeure

We are not liable for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, strikes, or government actions.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full effect.

Complete Agreement

These Terms, together with our Privacy Policy and any additional guidelines, constitute the complete agreement between you and ServiceLink SA regarding our services.
